Application and Amendment of the Terms and Conditions of Use
Access to and use of the Site imply full and unconditional acceptance of these Terms and Conditions of Use. The Publisher reserves the right to amend them at any time. The applicable Terms and Conditions of Use are those in force on the date of the order.
Description of the Intermediation Service
The website www.infotestadn.com is an information and commercial intermediation platform.
InfotestADN does not carry out any DNA tests and is not a medical analysis laboratory.
Our service consists exclusively of:
Informing users about existing genetic tests.
Selling a “Client Code” and managing the administrative procedures to connect the Client with the partner laboratory Endeavor DNA Laboratories (accredited ISO 17025 and AABB).
Access and Geographical Restrictions
Access to the Site is free. However, the User acknowledges that legislation concerning DNA tests varies from one country to another.
FRANCE-SPECIFIC WARNING:
In accordance with Article 16-11 of the French Civil Code and Law No. 2011-814 of 7 July 2011, the performance of genetic tests for recreational or convenience purposes (paternity, origins, etc.) is prohibited within French territory, except by judicial or medical decision.
By using this Site, any User residing in France acknowledges being informed of this prohibition. The Publisher declines all liability in the event of unlawful use of its services from a jurisdiction that prohibits such practices. The purchase and use of the services are carried out under the sole responsibility of the Client.
Order Process

Purchase of the Service: The Client orders an account management service and obtains a Client Code.

Payment: Payment is made in full at the time of the order (via Stripe). Prices are indicated in euros. VAT is not applicable.

Sampling kit: InfotestADN does not sell any medical kits. The Client receives instructions to carry out the sampling or must obtain the required equipment as indicated on the website.

Dispatch of samples: The Client sends their samples directly to the partner laboratory in the United States, at their own expense and under their sole responsibility.
Samples and Results

Analysis: Carried out exclusively by Endeavor DNA Laboratories in the United States.

Turnaround times: The turnaround times are provided for indicative purposes only (working days) from receipt of the samples by the laboratory. InfotestADN cannot be held liable for any logistical or technical delays on the part of the laboratory.

Results: Sent by email only. No results are sent by post.

Re-sampling: If the laboratory is unable to extract DNA (degraded or insufficient sample), a new sample will be requested. An administrative processing fee of €48 will apply for the handling of this new sample.
Right of Withdrawal and Refund
Consumer Law Compliance:
Before the start of performance: The Client has a period of 14 days to withdraw after placing the order, provided that the service has not been fully performed.
Exception (Waiver): Given the nature of the service (immediate provision of a Client Code and administrative processing), the Client agrees that performance begins immediately after the order is placed.
Partial refund: If a cancellation is requested before the samples are sent to the laboratory, administrative management fees (€40) will be deducted from the refund.
No refund: Once the samples have been received by the laboratory or the results have been delivered, no refund is possible, even if the result is inconclusive (the laboratory is subject to an obligation of means, not of result).
Liability
The Publisher acts as an intermediary. Its liability shall not be incurred for:
Errors made by the Client when taking samples or completing the forms.
Loss or damage to samples during transport to the laboratory.
The Client’s interpretation of the results (the results do not constitute a medical diagnosis).
Illegal use of the service in the Client’s country of residence.
Personal Data and Transfers (GDPR)
The Client’s data are processed in accordance with our Privacy Policy.
DATA TRANSFER OUTSIDE THE EU:
For the performance of the test, data and samples are transferred to the Endeavor DNA laboratory in the United States. This transfer is secured and governed by the European Commission’s Standard Contractual Clauses (SCCs).
By placing an order, the Client expressly consents to this transfer, which is necessary for the performance of the contract.
Governing Law and Jurisdiction
The present General Terms and Conditions are governed by Estonian law.
Any dispute relating to their interpretation and/or execution shall fall under the jurisdiction of the competent courts in Estonia.
MEDIATION (Mandatory EU):
In the event of a dispute, the consumer Client may avail themselves of free mediation or the Online Dispute Resolution platform of the European Commission: ec.europa.eu/consumers/odr.
