Infotestadn.com does not perform any genetic analyses or conduct DNA tests; its role is strictly limited to facilitating customer access to services offered by partner laboratories.
5. User Responsibility
The user is solely responsible for the use of the information and content available on the site. They agree to use the site in accordance with the laws in force in their country and these GTU. The user acknowledges that the use of the information contained on the site is at their own risk.
6. Rights and Obligations of the Publisher
The Publisher undertakes to update the information on the site and to provide accurate and clear content from reputed reliable sources. However, the Publisher cannot guarantee the accuracy or relevance of this data and cannot be held responsible for errors or omissions.
The site is accessible at all times, except during technical maintenance and updates. The Publisher cannot be held responsible for damages resulting from the unavailability of the site.
7. Information on Analyses
7.1 Description of Genetic Analyses: Infotestadn.com provides information on various types of DNA tests, such as genealogy, health and wellness, and relationship tests. These descriptions are provided for informational purposes only and may be updated or modified. The site does not conduct any genetic analysis and is not responsible for performing the tests, which are carried out exclusively by partner laboratories.

7.2 Use of Results: The DNA test results provided by the laboratory are for informational purposes only and must not be considered a medical diagnosis or professional medical advice. The Client acknowledges that it is their responsibility to consult a qualified healthcare professional for any interpretation or decision based on these results. It is therefore up to the Client to assess whether the laboratory service accessed via Infotestadn.com is suitable for their specific use.

7.3 Genetic Laboratory: All genetic analyses are performed exclusively by accredited laboratories, in accordance with ISO 17025 and AABB standards. Infotestadn.com acts solely as an intermediary and does not intervene in the analysis process.
8. Purchase Process

8.1 Service Request: To access a genetic analysis performed by a partner laboratory, the Client must submit a service request to obtain a CLIENT CODE assigned by Infotestadn.com. The Client is then responsible for preparing and sending their own genetic samples, as well as providing accurate, complete, and up-to-date information. The information submitted during the request and on the consent forms is used solely to facilitate the connection with the laboratory and the processing of the genetic analysis.

8.2 Price and Payment: The fees related to the CLIENT CODE are listed in euros and are not subject to VAT. The Client agrees to pay the full amount specified during their request, including any additional fees related to specific options. Payments must be made using the provided methods, particularly via the Stripe online payment service. The laboratory will not proceed with the analysis until payment has been confirmed.

8.3 Confirmation: The Client must provide a valid email address to receive information regarding the processing of their file, including instructions for sample collection and the delivery of results by the laboratory. Once the request is validated, a confirmation email is sent, summarizing the instructions to follow. It is the Client’s responsibility to carefully check this information and report any errors immediately.

8.4 Kit Preparation: Infotestadn.com does not provide any sample collection kit. The Client must assemble their own kit by following the instructions available on the site. Infotestadn.com is not responsible for delays or damages related to delivery services. The Client must take all necessary precautions when sending their samples. If the samples arrive damaged, the Client must send new ones.

8.5 Compliance with Instructions: The Client agrees to strictly follow the instructions provided by Infotestadn.com to enable the partner laboratory to conduct the genetic analysis under proper conditions. Samples must be compliant, and documents must be accurately and legibly completed. Any failure to comply may result in delays or inaccuracies in the results. In such cases, Infotestadn.com cannot be held responsible, and no refund will be granted.

9. Samples and Results
9.1 Sample Collection: Infotestadn.com provides the Client with detailed instructions to properly collect the necessary samples. These guidelines allow the Client to assemble their own collection kit using tools they must obtain independently. The Client agrees to follow the instructions precisely to collect samples in accordance with the indicated procedures. Any failure may result in service delays or inaccuracies in the results provided by the laboratory.
9.2 Sending and Returning Samples: Once the samples are collected, the Client must send them directly to the genetic laboratory responsible for the analysis. The partner laboratory is designated based on several parameters, such as the type of test requested or existing agreements with Infotestadn.com. Shipping costs for the samples are the responsibility of the Client. Infotestadn.com does not return samples after analysis unless expressly requested by the Client prior to receiving the results. In such cases, return costs are the sole responsibility of the Client.
9.3 Processing Time: Processing and result delivery times vary depending on the type of test requested and the chosen partner laboratory. The timelines provided by the laboratory are indicative and may be affected by several factors, such as sample quality, laboratory workload, or shipping delays. Infotestadn.com will make every effort to inform the Client of any complications that may delay result delivery but cannot guarantee a fixed timeline. The timeline begins only upon receipt of the samples by the laboratory. Transport time to the laboratory is not included in this calculation.
9.4 Re-sampling: If the samples submitted by the Client do not yield a usable DNA profile (due to insufficient, degraded, or contaminated DNA), re-sampling fees will apply. The Client must then submit new samples within 90 days to continue the analysis. No refund will be granted if the Client chooses not to submit new samples. Re-sampling

9.5 Result Delivery: The analysis results are transmitted by the laboratory to the Client via Infotestadn.com, exclusively by email. Any individual who participated in the test and provided their email address on the consent forms will also receive the results. No paper copies will be sent by postal mail.
9.6 Inconclusive Result: The Client understands and accepts that it is not possible to guarantee in advance that the analyses will produce a conclusive result. Some genetic profiles may lead to uninterpretable results. In such cases, no refund can be offered by Infotestadn.com or the laboratory.
10. Consent and Responsibility
10.1. Participant consent: it is the Client's responsibility to ensure that the tested persons consent to use their DNA for genetic analysis. The Client is responsible for ensuring that participants are aware of the need for confidentiality and that they should not disclose the report's content to anyone other than those authorized by the participants. The Client guarantees that they have the right to provide the Company with all the information and data and must indemnify the Company against any claim for information or data violation, breach of confidentiality, or non-compliance with data protection laws.
10.2. Damage suffered: the Company will not be responsible for any loss or damage suffered by the Client or any other person following the declaration of test results to participants or any other authorized person unless the Company has been negligent. The Client understands that there is a possibility of error, delay, or omission in the test procedure. The Client acknowledges and agrees that if the Client is able to establish a claim for damages resulting from any act of the Company (within 30 days of sending the report by email), negligence, or otherwise, the Company's liability will not exceed the cost paid for the test and agrees that the Company will be exempt from any other claim or damages.
10.3. Company responsibility: the Company cannot be held responsible for any failure or delay in performing its analysis services due to causes beyond its control, including but not limited to force majeure, flood, drought, storm, war, industrial action, strike, lockout, equipment failure, systems or network access failure, fire, explosion, terrorism, sabotage, or any other event beyond its control.
11. Legal
11.1. Order refusal: the Company reserves the right to refuse to provide its services if it has reasonable grounds to believe that the biological samples have been or will be obtained illegally, or that the results will be used for illegal, inappropriate, or unethical purposes, or if there is a conflict of interest with an existing Client, or if the quality of the Company's Services could be compromised, or if it has other reasonable grounds to do so.
11.2. Law and jurisdiction: the Client cannot use the Services or accept these general terms of sale if it is considered illegal to receive the Services under the laws of the jurisdiction in which the Client resides or from which the Client uses the Services. The Company cannot be held responsible for not verifying and confirming the Client's eligibility. The Client agrees to indemnify the Company against all claims, expenses, and losses or damages suffered by the Company due to the Client submitting samples that have not been legally obtained. The contract between the Company and the Client, as demonstrated by these general terms, is subject to European laws and courts, which will have exclusive jurisdiction regarding any claim or dispute arising from the contract.
11.3. Legal advice: the Client is responsible for obtaining the necessary legal advice to ensure that they have the right to possess and obtain the biological samples submitted to the Company for analysis. The Client should only enter into a contract with the Company if they are ready to be bound by these general terms.
12. Cancellation & Refund
12.1. Following instructions: failure to comply with the instructions may result in service delay, limitation of the Client's rights, or inaccuracies in test results. In such circumstances, the Company will not be responsible for such delay, refusal, or inaccuracy. No refund will be due in this case.
12.2. Cancellation request: the Client may cancel their order and request a partial refund if the analyses have not yet started. However, the Company does not offer any refund for the order if the analyses have already started or if the results have been delivered.
Any cancellation or refund request must be made by email to contact@infotestadn.com and must include the client code to be processed as quickly as possible.
Refund fee: 40.00€ or equivalent monetary value at the time of the transaction.
13. Confidentiality and Data Protection
13.1. Sample confidentiality: samples are processed anonymously and securely, exclusively by partner laboratories. Your samples will only be used for the ordered analysis and for the consent provided by the Client. Samples will not be shared with third parties without prior consent. The Client has the right to withdraw consent at any time during the Service provision by contacting the Company by email: contact@infotestadn.com.
13.2. Protection of personal data: we collect and process your personal data in accordance with our privacy policy to provide the requested service. No other use of the data regarding the purchase of a test will be made. The Company does not disclose personal data for marketing promotions. Data is not transmitted or transferred to third parties. The Client acknowledges and agrees to be bound by the terms of the Privacy Policy.
13.3. GDPR law: under data protection law, the Company will only obtain, use, process, and disclose the Client's personal information to the extent necessary to fulfil its responsibilities in providing the contracted Service and for similar purposes such as updating Client records, analysing statutory statements, crime prevention, and compliance with laws and regulations. The Client is entitled to a copy of the personal data held about them by the Company, and this data can be obtained free of charge.
13.4. Data retention and destruction: data is retained for 60 days and then automatically destroyed. No information, communication, or result will be retained after this period. Only the Client can request the deletion of all data and results free of charge. Data deletion on request is carried out within 30 days from the date of the request.
